It is a legal agreement between the user and MakeGoTrip and its subsidiaries, so, should be read very carefully only after accessing the site(www.makegotrip.com).
Also, any dispute regarding these terms and policies or the site will be resolved in San Diego, California, no matter where your residence is, should also be accepted.

MakeGoTrip withholds and take complete charge of NOT letting the user buy or seller sells the booking at erroneous prices in case of any system error or any technical issues in site.
Once all the issues are rectified and cross-checked, MakeGoTrip will notify you the right price leading the users NOT to have any purchases at erroneous reservations made at amended prices and to have only reservations at profitable prices.
Some of the products, services and content available on the Travel Site are provided by third parties (the "Service Providers"), which includes, the air carriers, hotels, car rental agencies, cruise lines, tour operators, insurance carriers and some of the other suppliers who provide travel & other services. Also, some software and data found on the Travel Site are the copyrighted property of the Service Providers and/or their third-party providers and distributors.

We ensure to have no joint venture, partnership, employment, agency or fiduciary relationship between you and MakeGoTrip as a result of your use of our travel services, including the official website (“The travel site”). MakeGoTrip acts as an independent contractor as a travel agent and the service provider at the travel site. We assist you to find best travel suppliers and make arrangements that stand up to your individual needs. Considering all the factors (such as supplier availability your preferences and any agreements we have to book travel in accordance with your company's travel policies) in identifying travel suppliers for our customers, we recommend the best suited itineraries. We also want you to be aware that certain suppliers pay us commissions as well as incentives for reaching sales targets or other goals, and may also provide incentives to our travel counselors. Some of the suppliers may also provide compensation to us for various marketing and administrative services performed for them, such as granting them access to our marketing channels, participating in marketing programs and supporting technology initiatives. We may also receive compensation from suppliers when customers use various forms of payment for products and services they consumed. From time to time we may enter into other business relationships with suppliers and the arrangements, including levels and types of compensation and incentives we receive, are subject to change.
You may only use the Travel Site to make legitimate reservations or purchases and should not use the Site for any other purposes, including making any speculative, false or fraudulent reservation or any reservation in anticipation of demand. You may not (a) use any "robot", "spider", or other automatic device, or a program, algorithm or methodology having similar processes or functionality, or any manual process to monitor or copy any of the web pages, data or content found on the Travel Site, (b) link to any portion of the Travel Site, without the prior written permission of MakeGoTrip, (c) use the Travel Site in violation of, or to violate, any law, rule or regulation, or (d) "frame", "mirror", or otherwise incorporate any part of the Travel Site into any other website without MakeGoTrip' prior written authorization.
You acknowledge and agree that you will not use, nor will you permit any use of, the Travel Site in conjunction with any of your activities or business by anyone that resides, stay or is accessing the Travel Site from a country prohibited under U.S. export and/or the Office of Foreign Assets Control regulations, including, but not limited to, regulations based upon sanctions, country programs against or embargoes. For more information regarding these regulations, visit www.treas.gov/ofac. You shall automatically become unauthorized to use the Travel Site in the event of a breach of this obligation.
You specifically agree to indemnify and hold harmless MakeGoTrip and the Service Providers for any breach of this "Use of Travel Site" section.
In case the applicable Service Provider dictates separate terms and conditions, then that will be additionally added to your reservation or purchase of any product or services on the Travel Site. You agree to abide by such terms and conditions, including payment of all amounts when due and compliance with the applicable Service Provider's policies, rules and restrictions regarding availability and use of fares, products and services. Any violation to any of the terms, conditions, policies, rules or restrictions may result in (a) your forfeiting any monies paid for such reservation or purchase, (b) cancellation of your reservation or purchase, (c) you being denied access to any flights, hotels or other products or services, and (d) MakeGoTrip debiting your account for any costs MakeGoTrip incurs as a result of such violation. You acknowledge that you, yourself will be responsible for all charges, fees, duties, taxes and assessments applied for your use of the Travel Site.
While accessing the site, you ensure or represent that you are of sufficient legal age to use the site and to create legal relationships for any liability you may incur. Also, you also tend to supervise all the terms and use of the Site by minors by your name and identity. You also warrant that all the information shared by you and your co-members are true and as per government ID. You should understand that you, yourself are responsible for all the uses you do at our site and those using your name or account. We retain the right to deny access to anyone to the Travel Site, at any time and for any reason, including without limitation for violation of these Terms of Use.
The services, material and other uses taken by you on the travel site are at your sole risk. The services provided on the travel site, are provided on an "as is" and "as available" basis.
The service providers are independent contractors and not employees or agents of MakeGoTrip. MakeGoTrip acts solely as a sales agent for the service providers and is not liable or chargeable for the acts, errors, omissions, representations, warranties or negligence of any such service providers or for any personal injuries, death, property damage or loss, or other damages or expenses resulting therefrom. MakeGoTrip shall not make any refund in case of any delay, cancellation, overbooking, strike, acts of war, terrorism, disease or other cause beyond its direct control, and MakeGoTrip will not be responsible for any additional expense, omissions, delays, re-routing, acts or omissions of any governmental authority. The fact that MakeGoTrip includes or offers any product or service on the travel site does not mean MakeGoTrip is supporting or recommending such product or service.
Affect to your computer equipment or other property on account of your access to, use of, or browsing in the travel site or the downloads of any materials, data, text, images, video or audio by the user from the travel site shall not be owned or taken into responsibility by MakeGoTrip or service providers. MakeGoTrip or any service provider shall not be liable for any injury, loss, claim, damage, or any special, exemplary, punitive, indirect, incidental or consequential damages of any kind (including, but not limited to lost profits or lost savings), whether based in contract, strict liability, or otherwise, which arises out of or is in any way connected with (a) any use of the travel site or content found herein, (b) any failure or delay (including, but not limited to the use of or failure to use any component of the travel site for reservations or ticketing), or (c) the performance or non-performance by MakeGoTrip or any service provider, even if such party has been advised of the possibility of damages to such parties or any other party. If, notwithstanding the foregoing, MakeGoTrip or any Service Provider should be found liable for any loss or damage that arises out of or is in any way connected with any of the above described functions or uses of the Travel Site or its content, the liability of each of MakeGoTrip and Service Providers shall in no event exceed, in the aggregate, the greater of (a) the transaction fees assessed for your transactions on the Travel Site, or (b) US $100.00. In its sole discretion, in addition to any other rights or remedies available to MakeGoTrip and without any liability whatsoever, MakeGoTrip at any time and without notice may terminate or restrict your access to any component of the Travel Site.
While most of the travels, either domestic or international is completed without incident, travel to certain destinations may involve more risk. MakeGoTrip urges customers to first review current travel advisories, warnings and restrictions issued by the United States government before making any reservations. In addition, passengers are responsible for determining and obtaining proper documentation for international travels. By offering SALE on any travel to offered destinations, MakeGoTrip does not ensure or warrant that travel to such destinations is safe, advisable or without risk, and is not liable for any damages or losses.
You acknowledge and agree that providing your persona; information to MakeGoTrip through the Travel site for the purpose of any booking or reservation, you consent to share the information with the service provider solely as necessary to complete the transaction you have requested.

You may defend and indemnify MakeGoTrip, Service Providers and their respective parents, subsidiaries, affiliates, and each of their officers, directors, employees and agents from and against any claim, cause of action or demand (including reasonable legal and accounting fees) brought by a third party as a result of your use of the Travel Site.
MakeGoTrip and the Service Providers owns the trademarks, logos and service marks, displayed on the Travel Site. All information and content including any software programs available on or through the Travel Site is protected by copyright (©).
All the Terms of Use will be governed by and written in accordance with the Laws of the State of California, without regard to conflict of law provisions. In case provision of these Terms of Use is held or deemed invalid, unlawful, void or unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any of the remaining provisions.
The customer agrees not to dispute the processing fee, airline ticket charge or fare adjustment if MakeGoTrip abides by the terms and conditions of the airlines and this agreement. Customer should contact MakeGoTrip in case he/ she does not receive any notification against the bookings made.
If you need to investigate any charge on your credit card, you can call or send us an E-mail at “customerservice@travelerhelpdesk.com” before disputing the charge with the credit card company. In case the customer attempts a Chargeback on a non-refundable airline ticket, service fee or a fare adjustment that fulfills the terms and conditions of the airline and this agreement; the customer agrees to refund the full amount of the chargeback plus a $250 penalty for the inconvenience and accounting fee. In cases the customer attempts a fraudulent chargeback, he/ she will be responsible for the cost required to initiate the legal proceedings in order to aid the potential loss imposed by the customer.
Upon any cancellation, where the passenger is not at fault and has not cancelled in violation of any terms and conditions, all sums paid to the seller will be promptly paid to the passenger, unless the passenger advises the seller of travel in writing, after cancellation. This provision does not apply where the seller of travel has refrained the payment to another registered wholesale seller of travel or a carrier, without obtaining a refund, and where the wholesaler or provider defaults in providing the agreed-upon service. Also, the seller of travel must provide the passenger with a written statement accompanied by bank records establishing the disbursement of the payment, and if disbursed to a wholesale seller of travel, proof of current registration of that wholesaler.
This transaction is covered by the California Travel Consumer Restitution Fund (TCRF) if the seller of travel was registered and participating in the TCRF at the time of sale and the passenger is located in California at the time of payment. Eligible passengers may file a claim with TCRF if the passenger is owed a refund of more than $50 for transportation or travel services which the seller of travel failed to forward to a proper provider or such money was not refunded to you when required. The maximum amount which may be paid by the TCRF to any one passenger is the total amount paid on behalf of the passenger to the seller of travel, not to exceed $15,000. A claim must be submitted to the TCRF within 12 months after the scheduled completion date of the travel. A claim must include sufficient documentation to prove your claim and a $35 processing fee. Claimants must agree to waive their right to other civil remedies against a registered participating seller of travel for matters arising out of a sale for which you file a TCRF claim.
